These Terms of Use ("Terms", "Terms of Use") govern your use of the Clara mobile application and related services (the "Service") operated by 44pixels Limited ("us", "we", or "our"), a company registered in the United Kingdom with its registered address at 99 Milton Keynes Business Centre, Foxhunter Drive, Linford Wood, Milton Keynes, MK14 6GD, United Kingdom.
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access or use the Service.
Clara enables you to configure and operate an AI-powered call answering agent for your business. The Service may allow you to:

Authority and Accuracy: You are solely responsible for (i) ensuring you have the authority to use and forward calls from any phone number or telephony system you connect to the Service, and (ii) ensuring all information you provide to train or configure the agent ("Business Information") is accurate, lawful, non-misleading, and kept up to date.
Your Relationship with Callers: You are the party responsible for your relationship with your customers and callers. Clara is a tool you use to communicate with them. You are responsible for determining whether the Service is suitable for your business, your sector, and your compliance obligations.
High-Risk and Special Categories: You must not rely on Clara for emergencies or time-critical public safety situations. You must not use Clara as a substitute for professional advice (including legal, medical, financial, or regulated advice) unless you have implemented appropriate human review and safeguards.
No Emergency Use; No Guaranteed Pickup: The Service is not an emergency service. We do not guarantee that calls will be answered, routed, recorded, transcribed, or summarised, nor do we guarantee response times or availability. You are responsible for maintaining alternative processes for urgent or critical situations.
Clara answers your calls only if, and when, you choose to forward them to the Service. Call forwarding is a feature of your own phone and mobile network. You enable it yourself, either through your device's settings or by dialling the activation codes provided by your mobile carrier. The Service works by receiving calls that you have chosen to forward to it.
You Set It Up: You are solely responsible for enabling, configuring, testing, and maintaining call forwarding to the Service. By setting up call forwarding, you are instructing your own mobile carrier to route your calls to the Service, and you confirm that you have the authority to do so. We provide instructions and in-app guidance as a convenience only; the decision to activate forwarding, and the act of activating it, are yours.
We Cannot Access or Control Your Phone: The Service does not, and cannot, access, control, modify, or "take over" your phone, SIM, handset, device settings, or carrier account. We have no ability to switch call forwarding on or off on your behalf. Any forwarding, diversion, or routing of your calls results solely from settings that you apply to your own device or carrier account, and not from any action taken by us.
You Can Turn It Off at Any Time: You may disable call forwarding at any time through your device settings or your carrier's deactivation code, and instructions for doing so are available in the app and our Help Centre. If you no longer wish for your calls to be answered by the Service, you are responsible for disabling call forwarding yourself. Uninstalling the app, cancelling your subscription, or deleting your account does not, on its own, remove call forwarding that you have configured on your device or with your carrier; you must deactivate it yourself.
Carrier Terms and Charges: Call forwarding may be subject to your mobile carrier's own terms, conditions, and charges. We are not responsible for any carrier fees, connection charges, coverage, or network behaviour associated with forwarding your calls.
To the fullest extent permitted by law, you accept sole responsibility for your decision to enable call forwarding, and we are not liable for any claim, loss, cost, or inconvenience arising from it — including your calls being answered, diverted, or handled by the Service, any call you consider missed as a result, or any assertion that the Service redirected, interfered with, "hijacked", or took control of your phone or phone number. Enabling call forwarding is your choice, performed by you on your own device and carrier account, and is done at your own risk.
The Service assigns you a dedicated telephone number (your "Clara Number"), provisioned through third-party telephony providers. You may use it as the destination for call forwarding, or you may publish it directly as a line for your business so that callers reach the Service by dialling it. Which of these you do, and where and how you advertise the number, is your choice and your responsibility.
Licence, Not Ownership: Your Clara Number is licensed to you for use with the Service for as long as your subscription (including any trial period) is active. You do not acquire ownership of, or any property right in, the number. Porting a number into or out of the Service is subject to the processes of our underlying telephony providers and to applicable porting regulations, and is handled case by case; contact support before relying on it.
Number Lifecycle on Cancellation: If your subscription ends, your Clara Number is held for a short grace period (currently seven days) and is then released and may be reassigned; where your access is terminated for breach of these Terms, we may release the number immediately. You are responsible for updating any advertising, listings, signage, or materials that display the number before it is released, and after the number is released you must stop holding it out as your number and you are responsible for any claims arising from your continued advertising or use of it. To the fullest extent permitted by law, we are not liable for calls, messages, or business reaching a released or reassigned number after your subscription ends.
Third-Party Networks: Numbers depend on third-party telephony providers and carriers. In rare cases we may need to change or substitute your Clara Number where required by a provider, carrier, or regulator; we will give you reasonable notice where practicable. We do not guarantee that calls or messages to your Clara Number will be free from carrier blocking, filtering, or spam labelling.
Messaging from Your Clara Number: The Service may allow you to send and receive text messages using your Clara Number, including automated follow-up messages. You are solely responsible for ensuring that your messaging complies with applicable laws and carrier requirements, including obtaining any required consent from recipients, honouring opt-out requests, and complying with anti-spam and telemarketing rules (including, where applicable, the US TCPA and CTIA/carrier messaging policies, the UK's PECR, Canada's CASL, and equivalent rules in other jurisdictions). For some numbers (including US numbers), business messaging may require registration of your business details with carriers or messaging registries; where we perform such registration you authorise us to submit your Business Information for that purpose, and messaging may be limited or unavailable until any required registration is complete. We do not guarantee message delivery and are not liable for carrier filtering or blocking of messages.
No Emergency Use: Your Clara Number is answered by the Service and is not a substitute for an emergency-capable telephone line. The Service does not support calls to emergency services (such as 911, 999, or 112), and any attempt to place such calls through the Service will not connect you to emergency services. You must not publish your Clara Number as an emergency contact, and you must maintain a conventional line for contacting or being contacted by emergency services, consistent with the "No Emergency Use; No Guaranteed Pickup" provision above.
The Service may process call audio and related metadata, and may record and/or transcribe calls to provide the Service, generate summaries, improve quality, and for safety and abuse prevention.

The Service may allow you to place return or outbound calls to callers and to present a chosen number, such as your own business number, as the Caller ID (Calling Line Identification, or "CLI") instead of an underlying network or platform number.

You acknowledge that Caller ID presentation depends on third-party telephony networks and carriers, and we do not guarantee that a chosen number will be displayed, delivered, or free from blocking or spam labelling. We are not liable for any claims, losses, or penalties arising from the number you configure, your display of Caller ID, or any outbound calls you place using the Service.
No Guarantee of Accuracy: The Service uses AI-based technology. Responses, transcriptions, summaries, and action items may be inaccurate, incomplete, misleading, or inappropriate for your specific context.
Verification Required: You are responsible for reviewing and verifying outputs before relying on them, acting on them, or using them to communicate with customers.
No Professional Advice: Outputs are provided for informational and workflow support purposes only and do not constitute professional advice of any kind.
You acknowledge that the agent may communicate with callers on your behalf based on your Business Information and configuration. You are responsible for:
No Authority to Bind: Unless you explicitly configure otherwise, the agent is not authorised to enter into contracts, provide binding quotes, accept refunds, make guarantees, or modify your terms with callers.
We are not responsible for missed opportunities, bookings, commitments, refunds, pricing errors, availability issues, contractual arrangements, or representations made to callers arising from your configuration or use of the Service.
You represent and warrant that:
Sensitive Data: You must not intentionally provide or configure the Service to collect highly sensitive data (for example payment card details, government IDs, passwords, or medical information) unless you have obtained all required consents and implemented appropriate safeguards.
For Customer Data processed on your behalf, we act as a data processor and you act as the data controller under applicable data protection law.
We may act as an independent controller for limited purposes such as security, fraud prevention, service improvement using de-identified data, and compliance with legal obligations.
Processing is governed by our Privacy Policy and, where required, a Data Processing Addendum (DPA).
We may retain Customer Data and Business Information for as long as reasonably necessary to provide and improve the Service, comply with legal obligations, resolve disputes, and enforce these Terms. You may request deletion of your account and associated data by contacting us. Some data may be retained where required by law or for legitimate business purposes (for example security, fraud prevention, and audit logging).
Purchases, subscriptions, renewals, trials, and refunds are handled via the relevant mobile application store and are subject to that store's terms and policies. We cannot grant refunds directly for purchases made through a mobile application store.
Where you purchase directly from us rather than through an application store, refunds are governed by our Refund Policy.
We may apply reasonable fair usage limits (for example call minutes, concurrent calls, transcription volume, storage, or rate limits) to protect service quality and prevent abuse.
We do not currently enforce fixed numeric caps. However, we reserve the right to introduce or adjust limits by plan over time. Where changes materially affect normal usage, we will provide reasonable advance notice.
We may restrict or suspend usage that is excessive, abnormal, or harmful to our infrastructure or other users.
You must not attempt to bypass limits, overload the Service, resell the Service without permission, or use the Service in a manner that degrades performance.

Clara is built solely for legitimate business call handling. You must not use, configure, or permit anyone else to use the Service for any unlawful, harmful, or abusive purpose. This includes, without limitation, sexual or adult services (such as "sex lines" or sexually explicit conversations), scams or fraud, harassment, hate, or threats, and the creation, request, or exchange of illegal, obscene, or otherwise objectionable content.
Zero Tolerance: We do not permit this use under any circumstances. Where we reasonably believe the Service is being misused, we may suspend, restrict, terminate, or permanently ban your access at any time, immediately and at our sole discretion, without prior notice and without refund. We may also suspend or ban any other accounts we reasonably believe are associated with, linked to, or controlled by the offending account, and may report unlawful activity to law enforcement or other relevant authorities.
No Accountability for Misuse: The Service is a tool that you configure and control. 44pixels Limited is not responsible or liable for, and expressly disclaims any accountability for, any content, conversations, or activities you create, configure, enable, or engage in through the Service in breach of these Terms. You are solely responsible for such use, and you agree to indemnify and hold us harmless against any claims, losses, or liabilities arising from it.
The Service relies on third-party services (including telephony providers, cloud infrastructure, and AI providers). We are not a telecommunications provider and are not responsible for carrier outages, call delivery failures, call blocking, spam labeling, number reputation issues, or failures caused by third-party networks or services. Your use of such services may be subject to their own terms and policies.
The Service and its original content are owned by 44pixels Limited. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes, subject to these Terms.
You retain your rights in your Business Information and Customer Data.
You grant 44pixels a non-exclusive, worldwide, royalty-free licence to host, store, process, and use Business Information and Customer Data solely to operate, maintain, secure, support, and improve the Service. Where permitted by law, we may use de-identified and/or aggregated data to improve reliability, safety, and performance.
Your use of the Service is subject to our Privacy Policy.
By creating an account or otherwise providing us with your email address, you agree that we may contact you at that address about your account, the Service, and important service updates.
You also agree that we may send you promotional communications, such as product news, offers, tips, and information about features or other products and services offered by 44pixels Limited. You can opt out of promotional emails at any time by following the unsubscribe instructions in those emails or by contacting us at [email protected]. Even if you opt out, we may still send you non-promotional messages, such as those about your account or our ongoing business relationship. Our handling of your information is described in our Privacy Policy.
We may modify, update, suspend, or discontinue any part of the Service at any time, including features, integrations, AI models, or functionalities.
We are not liable for modification or discontinuation of features. Continued use of the Service after changes constitutes acceptance of the updated Service.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant uninterrupted operation or accuracy of AI outputs.
We do not guarantee availability or data preservation. We are not responsible for data loss except where required by applicable law.
To the maximum extent permitted by law:
Liability Cap: Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid to us in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
You agree to indemnify and hold harmless 44pixels Limited from claims arising from your use of the Service, your data, or your legal non-compliance.
We may suspend or terminate access if required by law, for security reasons, or for violations of these Terms. Obligations that should survive termination will do so.
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction.
We may update these Terms at any time. Continued use constitutes acceptance.
These Terms and our Privacy Policy constitute the entire agreement.
Invalid provisions will be modified to the minimum extent necessary; remaining provisions remain in effect.
